Now that the ECJ has also ruled on the first question referred by the Federal Court of Justice (BGH), the BGH will hear the case on 27 July 2023 at 9.00 a.m. on the permissibility of offering cigarette packs through vending machines at supermarket checkouts (case reference I ZR 176/19). The plaintiff, a non-smokers’ association, is being represented by Merx Pütz Rechtsanwälte. The outcome of the proceedings is eagerly awaited because it could be decisive for the presentation of cigarette packs on (vending) machines and therefore for the question of whether the deterrent warnings must also be displayed.
