A court injunction requires immediate implementation. To do this, you must first identify the advertising materials and products directly affected and those that are identical in essence to the court ban. Furthermore, active measures may have to be taken to prevent the continuation of the prohibited behaviour. Otherwise, there is a risk of an administrative fine due to a breach of the injunction. Case law places high demands on the party seeking the injunction.
It is therefore advisable to proceed in a planned manner when implementing an injunction, for example on the basis of a procedural instruction (SOP). This should specify the concrete measures and, ideally, provide templates for various standard situations. The SOP should also contain checklists to ensure complete implementation.
